Terms of Service for NPC Mode
These Terms of Service ("Terms") govern access to and use of the NPC Mode mobile application, website, and related services provided by NPC-Inc ("NPC-Inc," "we," "our," or "us"). By creating an account, accessing, or using NPC Mode, the user agrees to these Terms.
1. Eligibility
Users must be at least 18 years old, or the age of legal majority in their jurisdiction, to enter into these Terms, unless they have the permission of a parent or legal guardian where applicable.
2. Account Registration
A user may need to create an account to access some features. Users agree to provide accurate information, keep account credentials secure, and remain responsible for activity under their account.
NPC-Inc may suspend or terminate accounts that are fraudulent, abusive, unlawful, or in violation of these Terms.
3. Use of the Service
Users may use NPC Mode only in compliance with applicable law and these Terms. Users may not:
- use the service to violate the law or the rights of others;
- attempt to gain unauthorized access to systems, data, or accounts;
- interfere with the operation or security of the service;
- upload, transmit, or create harmful, infringing, or abusive content through the service;
- reverse engineer, copy, scrape, or exploit the service except as permitted by law.
4. User Content
Users retain ownership of the content they submit to NPC Mode, subject to the rights necessary for NPC-Inc to operate the service. By submitting content, the user grants NPC-Inc a limited, non-exclusive, worldwide license to host, store, reproduce, process, and display that content solely for the purpose of operating, improving, securing, and providing the service.
Users are responsible for the legality and appropriateness of their content.
5. Subscriptions and Billing
NPC Mode may offer paid subscriptions, premium features, or trial periods. Pricing, features, and billing terms may be displayed in the app or applicable storefront.
If a user purchases a subscription through Apple App Store or Google Play, billing, renewals, cancellations, and refunds are generally handled by the applicable app store under that storefront's rules. RevenueCat may be used to manage subscription status and entitlements across platforms.
Unless otherwise stated by the storefront, subscriptions automatically renew until cancelled. Users are responsible for managing subscriptions through their Apple or Google account settings.
6. Changes to Features and Pricing
NPC-Inc may modify, suspend, or discontinue any part of the service at any time, including features, functionality, or pricing, to the extent permitted by law. NPC-Inc will attempt to provide reasonable notice when practical for material changes.
7. Intellectual Property
NPC Mode, including its software, design, branding, text, graphics, logos, and other content provided by NPC-Inc, is owned by NPC-Inc or its licensors and is protected by applicable intellectual property laws.
Except for the limited right to use the service under these Terms, no rights are granted to the user.
8. Termination
Users may stop using the service at any time. NPC-Inc may suspend or terminate access if the user violates these Terms, creates risk or possible legal exposure, or if the service is discontinued.
Sections that by their nature should survive termination will survive, including provisions related to ownership, disclaimers, limitations of liability, dispute resolution, and payment obligations.
9. Disclaimers
NPC Mode is provided on an "as is" and "as available" basis to the maximum extent permitted by law. NPC-Inc makes no warranties, express or implied, regarding reliability, availability, accuracy, fitness for a particular purpose, non-infringement, or uninterrupted operation.
NPC Mode may include AI-assisted or generated content. Such content may be inaccurate, incomplete, fictional, or inappropriate for a user's intended purpose. Users are responsible for reviewing and evaluating outputs before relying on them.
10. Limitation of Liability
To the maximum extent permitted by law, NPC-Inc and its affiliates, officers, employees, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to the service or these Terms.
To the maximum extent permitted by law, the total liability of NPC-Inc for claims arising out of or related to the service or these Terms will not exceed the greater of the amount the user paid to NPC-Inc for the service in the 12 months before the event giving rise to the claim, or 50 USD.
11. Indemnification
To the extent permitted by law, the user agrees to defend, indemnify, and hold harmless NPC-Inc and its affiliates, officers, employees, licensors, and service providers from claims, liabilities, damages, losses, and expenses arising from the user's use of the service, content, or violation of these Terms.
12. Governing Law
These Terms will be governed by the laws of the jurisdiction in which NPC-Inc is established, without regard to conflict of law principles. The specific venue and governing law may be updated when NPC-Inc finalizes its legal domicile.
13. Changes to These Terms
NPC-Inc may update these Terms from time to time. If changes are material, NPC-Inc may provide notice through the app, website, or other reasonable means. Continued use of the service after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
